Definitions of Tier 2, 4 and 5 workers and students The U.K. Border Agency has now announced definitions of Tier 2, 4 and 5 workers and who can come to U.K. This announcement gives details of various categories of workers, who should in future apply under the respective tier in order to get a visa to come to U.K. These definitions are detailed here-under for the convenience of prospective immigrants. Tier 2 - skilled worker category The tier 2 - skilled worker (general) category is for skilled workers with a job offer to come in to fill gaps in the United Kingdom labour force that cannot be filled by the resident workforce. The job must be at S/NVQ level 3 or above and the migrant must earn the appropriate salary or other package of remuneration appropriate for the job in the United Kingdom. Tier 2 intra-company transfer category The intra-company transfer category is for employees of multi-national companies who are being transferred by an overseas employer to a skilled job in a United Kingdom entity (body). The transferring employee must have at least six months experience of working for the overseas entity, directly before the transfer. If you own shares in two or more entities, this does not mean that you can apply under tier 2 - intra-company transfers category. Because of the specific nature of these transfers, you do not have to meet the resident labour market test. However the migrant must have been working in an overseas part of your organization for at least six months before the transfer. The job must be at S/NVQ level 3 or above and the migrant must earn the appropriate salary or other package of remuneration appropriate for the job, such as specific allowances we deem appropriate, in the United Kingdom. Tier 2 - sports people category The tier 2 - sports people category is for elite sports people and coaches:  who are internationally established at the highest level; and  whose employment will make a significant contribution to the development of their sport at the highest level in the United Kingdom; and  who intend to base themselves in the United Kingdom. Migrants under this category must be sponsored by a club (or equivalent) that is licensed by Home Office to issue certificates of sponsorship under this category. Tier 2 - ministers of religion category? The tier 2 - ministers of religion category includes those coming to fill vacancies as religious workers within recognized religions, and anyone who ministers, whether regularly or occasionally, and performs pastoral duties or both. Pastoral duties include:  leading worship regularly and on special occasions;  providing religious education for children and adults by preaching or teaching;  officiating at marriages, funerals and other special services;  offering counseling and welfare support to members of the congregation;  recruiting, training and coordinating the work of any local volunteers and lay preachers. This category is also for migrants coming to work in the United Kingdom as:  a missionary;  a member of a religious order such as a monastic community of monks or nuns, or a similar religious community which involves permanent commitment. Tier 5 - creative and sporting category This category is for migrants who want to come to the United Kingdom to work or perform as sports people, entertainers or creative artists for up to 12 months. It does not cover people who currently enter the United Kingdom under the permit-free concessions for entertainers, including permit-free festivals, and sports people. These concessions will be brought within the immigration rules (outside of the points-based system) under the revised visitor categories. More information on the new visitor categories will be published on our website soon. These migrants will be issued with a certificate of sponsorship number and an additional process will be introduced to enable them to gain entry at the port. More information about this process will be available on this website in autumn 2008. Separate arrangements will allow appropriate checks to be made at the port of entry. These arrangements will be further outlined in the policy guidance, which is due later this year, and will be published soon. Tier 5 - charity worker category? Migrants coming to work temporarily in the United Kingdom as charity workers should only do voluntary activities and not paid work. The migrant should intend to carry out work directly related to the purpose of your organization. Migrants entering the United Kingdom under the charity workers category will be given a maximum of 12 months' permission to stay. Their dependants will be allowed to work if they are accompanying or joining them in the United Kingdom. Tier 5 - religious worker category? This category is for migrants coming to work temporarily in the United Kingdom as:  religious workers in a non-pastoral role, where the duties include performing religious rites.
